The development of online education system in the Russian Federation has accelerated significantly with the onset of the COVID-19 pandemic, which required an immediate response from the public authorities. Online courses as a form of educational programs at universities allows for the continuity of the learning process in a remote form due to the restrictions imposed since the beginning of the pandemic. The process of digitalization began long time before 2020, with the adoption of the state strategic programs in the field of education, in which online education plays an important role. Despite a widespread use of online courses there remain problems of a legal and organizational nature. The solution of such problems at the federal level will ensure a more effective implementation of the constitutional right of citizens to get quality and affordable education. To solve these problems the article proposes the principle of joint use of state property by universities which is created at the expense of budgetary funds and supported by appropriate legal regulation on the part of the state authorities at the federal and regional levels.
